OKLAHOMA SUPREME COURT ON DUAL AGENCY
In Snider v. Oklahoma Real Estate Commission, the Oklahoma Supreme Court's decision on June 1, 1999 stated: "Sellers' agents and dual agents do not and cannot by law give a buyer the same degree of loyalty as an agent who acts on behalf of a buyer. Sellers' agents owe their allegiance to the seller. Dual agency invites a conflict of interest. A buyer who relies on the seller's agent or on dual agency does not receive the same degree of legal protection as that afforded by an agent acting solely on behalf of the buyer".
CONSUMER NOTICE
Nowadays many real estate sellers' agents will often claim that they can be a "buyer's agent", a "buyer's broker", or even an "exclusive buyer's agent" or an "exclusive buyer's broker". How can you tell if they are a true Exclusive Buyer's Agent (EBA) or an Exclusive Buyer's Broker? Very easily. Just ask the following question:
"Does the company you work for list property for sale?"
If they answer "Yes", they are not an Exclusive Buyer's Agent/Broker and cannot legitimately claim to be so. The use of an Exclusive Right-to-Represent Buyer's Agency Agreement does NOT turn a Non-Exclusive part-time buyer agent into a true full-time Exclusive Buyer's Agent/Broker. This contract "locks" a homebuyer into using only that agent and company for the purchase of any home, including their own company listings, creating dual agency risks and conflicts. The truth is dual agency is great for the real estate company but not very good for homebuyers. Dual agency no longer provides homebuyers with representation and protection while financially benefitting the listing company with both the listing and selling sides of the commission- twice the money!
